Accident and injury cases are
usually based on the law of negligence. Negligence
is defined as the failure to act as a reasonable person would act
under the same or similar circumstances. In Tennessee and many other
states, a person whose negligence causes an injury or death is considered
to be at fault. Sometimes negligence is obvious, such
as when a drunk driver runs a stop sign. In other cases negligence
must be proved in court by the testimony of highly trained and qualified
experts. Negligence cases that would normally require expert testimony
include medical malpractice and defective-product cases.
The majority of states in the
U.S., including Tennessee, have adopted a system of comparative
fault. Under the law of comparative fault an injured person may
be able to receive partial compensation, referred to as damages,
even if he was partly at fault in causing the accident. In Tennessee
you can still recover compensation or damages if the person who
caused your injury was more at fault than you were. If you have
