Tennessee’s new medical malpractice procedures

Adopted in October 2008 and amended in July 2009, Tennessee’s new medical malpractice procedure requires that written notice be given to the doctor, hospital, or health care provider 60 days prior to the date the lawsuit is filed. This written notice must also be given before the expiration of the statute of limitations—typically one year in Tennessee.

According to the new law, individuals or their attorneys must file a Certificate of Good Faith with the court when a medical malpractice lawsuit is filed. The Certificate of Good Faith must state that a medical expert has provided a written statement confirming that there is a good faith basis to believe that medical malpractice has occurred, and that the malpractice has caused injury or death to the patient.
