TN Auto Accident Law
What is the driver responsibility?
After being involved in an auto accident it can sometimes be difficult to know who is at fault and how far their responsibility extends. To help drivers understand their responsibilities and liability in Tennessee, the Kingsport law firm of Hawkins, Bingham & Miller explain some of TN’s auto accident laws.
Accident Liability
To determine who is at fault for an accident, you must consider the actions and behaviors of the driver of each vehicle involved. According to the law, a driver is at fault if they:
- Act negligently
- Act recklessly
- Act with intentional misconduct
Negligence is the failure to act as a reasonably careful driver would normally act under the same circumstances. Negligent or carless driving that casues damage or injuries is one of the leading causes of auto accidents. If a driver acts negligently and causes an accident they are at fault. Additionally, if a driver acts recklessly or with intentionally careless action, they can also be held responsible for any accidents or injuries they cause.
When on the road, all drivers have the responsibility to act with care, caution, and respect for other drivers. If an auto accident has occurred, all drivers involved have the responsibility to remain on the scene until the proper authorities have arrived. Failure to do so may result in criminal charges.
The best way to determine who is responsible for your auto accident is to speak with a personal injury attorney and have them examine the circumstances of the incident. Your attorney will be able to help you determine who is responsible and for how much.
