Medical Malpractice

In many respects medical care is better today than it has ever been. Most of today's physicians have received highly specialized training. Advances in medical technology have given us sophisticated diagnostic and testing equipment such as MRI machines and modern surgical techniques like laparoscopy. Despite all of the advances in medicine in recent years, health care in the United States is not a safe as it should be. A recent study by the Institute of Medicine found that in one year, as many as 98,000 people died in hospitals as a result of medical errors and mistakes. More people died in hospitals from medical errors than were killed in automobile accidents on our nation's highways.

Medical errors or mistakes are a special kind of negligence known as medical malpractice. In order to recover compensation in a medical malpractice case against a doctor or hospital, you must be able to prove that the medical care that you received was below the standard of care. The standard of care is the acceptable level of medical care generally provided by other doctors in the same locality. Medical malpractice ordinarily must be proved by qualified and knowledgeable medical experts who testify regarding the standard of care. These experts are usually other doctors or medical providers with training and experience similar to that of the doctor who committed the malpractice.

The lawyers at Hawkins, Bingham & Miller will review your medical records and consult with medical experts to determine whether or not you have a meritorious medical malpractice case against a doctor or hospital. Once it is determined that you have a meritorious case, we retain experts to give opinions on your behalf and to testify in court, if necessary.

If you believe that you or a member of your family has been a victim of medical malpractice you may want to contact us to discuss your rights. There is no charge for a consultation, and we do not charge an attorneys' fee unless we are successful in your case and you recover compensation.
