Compensation
Every state, including Tennessee, has laws that provide for
workers' compensation benefits to be paid to injured workers.
To receive workers' compensation benefits, it is not necessary that
the employer be at fault in causing the accident. In most
cases benefits will be paid even if the employee was at fault.
There are
generally three types of workers' compensation benefits.
Medical benefits are paid to the doctors and other medical providers
who treat the work related injury. A person off work
recovering from a work related injury is usually entitled to receive
temporary benefits. Benefits are also paid when the injury
results in a permanent impairment. The amount of benefits
payable for permanent impairment depends on the type of injury and
the disability that it causes. Both temporary and permanent
benefits are based on a percentage of the injured worker's average
weekly wage. |
